Terms of Service for Flaree Application
I. General Provisions
These terms and conditions specify the rules for using the Flaree motivational application offered by Mobile Reality Spółka z Ograniczoną Odpowiedzialnością, located at ul Grzybowska 62, 00-844 Warsaw, registered under NIP: 701-055-92-96, hereinafter referred to as the "Application."
The terms are available on the website and come into effect on [Date].
II. Definitions
User: A person or entity using the Flaree Application within a specific Organization.
Personal Data: Information relating to an identified or identifiable individual, collected during the use of the Application, such as name, surname, and email address.
Organization: An entity where Employees and the Company Owner are located.
Application: The Flaree application.
Company Owner: A User who owns the company and manages the Organization. They have full access to all Application functionalities.
Employee: A User who is an employee under a specific Organization. They have access to certain Application functionalities depending on their assigned role as Administrator, Editor, or Giver.
Slack Integration: The process that allows for the creation of an Organization and the assignment of a Company Owner and Employees.
Kudos: A reward as a digital record in the database, given to Employees by the Company Owner or Giver within the Organization.
Collectibles: A reward as a digital token in the Flow Blockchain system, which can be given by the Company Owner or a User with Collectibles Permissions within the Organization. This token can only be created from Kudos or Special Kudos.
Special Kudos: A reward as a digital record in the database, composed of at least three Kudos within the Organization.
Editor: A User with permissions to be an Editor within the Organization.
Administrator: A User with permissions to be an Administrator within the Organization.
Giver: A User with permissions to be a Giver within the Organization.
Collectibles Permissions: Permissions allowing a User to access and manage tokens.
Subscription Plan: A subscription plan granting access to the Organization and its Users.
Fees: Monthly or annual fees for the Subscription Plan.
Billing Data: Billing information used to collect Fees for the Subscription Plan.
Seats: The number of available user spots, defining the maximum number of users in one Organization and affecting the Fees.
III. Terms of Use
The Application can be used:
After registration, acceptance of these terms, and payment of the Subscription Plan.
By using a free 2-week Subscription Plan.
By using a free Subscription Plan offered seasonally that time may vary.
Access to the Application for all Users may be blocked if:
The current Subscription Plan has ended.
These terms are violated.
The Subscription Plan can be terminated if:
The Fee cannot be collected from the Company Owner within the Organization.
The Company Owner cancels the Subscription Plan.
Users must provide true information during registration and update it if changes occur.
The Application is designed to motivate employees through a rewards system in the form of Kudos and Collectibles.
Users can be either a Company Owner or an Employee.
Employees are entitled to:
Manage their data by adding and editing it.
Receive rewards as Kudos or Collectibles.
View received Kudos.
View received Collectibles.
Manage their Digital Wallet by setting a default address.
Employees may have additional permissions:
Giver: An Employee with permission to give created Kudos.
Editor: An Employee with permission to manage Kudos and users within the Organization.
Administrators are Employees with permissions to manage Kudos, users, and billing data within the Organization.
Employees with Collectibles Permissions can convert Kudos to Collectibles and transfer tokens to other Users.
The Company Owner is entitled to manage their data, Kudos, users, billing data, Collectibles, and Digital Wallet.
IV. Personal Data Protection
The data controller is Mobile Reality Spółka z Ograniczoną Odpowiedzialnością.
Users' personal data is processed in accordance with applicable law, especially the EU General Data Protection Regulation (GDPR).
Personal data is collected and processed to provide services offered by the Flaree application, as well as for marketing and statistical purposes.
Users have the right to access, correct, delete, restrict processing, transfer their data, object to processing, and withdraw consent at any time.
Detailed information on personal data processing is available in the Privacy Policy on the website.
V. Users' Rights and Obligations
Users must use the Flaree Application in accordance with its purpose and applicable law.
Providing illegal or infringing content is prohibited.
Users are fully responsible for actions taken within the Application.
VI. Rights and Obligations
Mobile Reality Spółka z Ograniczoną Odpowiedzialnością commits to providing services in accordance with these terms and applicable law.
Mobile Reality Spółka z Ograniczoną Odpowiedzialnością reserves the right to make changes to the Flaree application, which will be communicated to Users via the website and email.
VII. Complaints
Users have the right to file complaints regarding the operation of the Application.
Complaints should be submitted via email to hello@thenftreality.com.
Complaints will be addressed within 14 business days.
VIII. Final Provisions
Mobile Reality Spółka z Ograniczoną Odpowiedzialnością reserves the right to change these terms. Users will be informed of any changes via the website and email.
Matters not covered by these terms are governed by Polish law.
These terms come into effect on 31.08.2024.
